Access to information on the environment

Under article 6 of the European Communities (Access to Information on the Environment) Regulations 2007 – 2018 (AIE Regulations) every person has a legal right to access environmental information held by, or for public authorities, subject to the provisions and exemptions set out in the AIE Regulations.

About AIE Requests

Under article 6 of the AIE Regulations, a request for environmental information must:

  • Be made in writing or electronic form
  • State that the request is made under these Regulations
  • State the name, address and any other relevant contact details of the applicant
  • State, in terms that are as specific as possible, the environmental information that is the subject of the request, and
  • If the applicant desires access to environmental information in a particular form or manner, specify the form or manner of access desired.

The right to access environmental information held by public authorities is subject to exemptions under the AIE Regulations such as Article 7(5) the record requested is not held by or for the authority, Article 8(a)(iii) a record is subject to the protection of environmental information, Article 8(a)(i) a record disclose personal information, Article 9(1)(c) a record contains commercially sensitive information or other exemptions.
